SECRET #2

IEP Meetings Disrupt The IEP Team's Daily Schedules.

One hidden factor that many parents are unaware of is how tightly scheduled schools are when it comes to IEP meetings. School districts and staff often face large caseloads, with teachers, therapists, and administrators balancing numerous students’ needs each day. The typical school day is tightly packed, and the schedule often leaves little room for detailed discussions or extended planning. When parents attend IEP meetings unprepared, the meeting can be completed quickly, as there’s less likelihood of requests for additional services or changes to standard procedures. This works in the school’s favor, allowing them to efficiently move through meetings without disrupting their daily routines or stretching resources.

​However, parents... you need to know this:  Under the LAW... The Individuals with Disabilities Education Act (IDEA), there is no strict time limit for how long IEP meetings can last. According to the law, the IEP team, which includes the parents, educators, and relevant specialists, must meet to review and discuss the child's educational progress, goals, and the services necessary to support their learning. IDEA emphasizes that these meetings should be conducted in a manner that allows for thorough discussion, ensuring all concerns and needs are addressed, which inherently means they can take as long as necessary to achieve this goal.

Specifically, the regulations allow parents to fully participate and advocate for their child, ensuring that the IEP is tailored to the individual student's requirements. The Department of Education outlines that this collaborative process is fundamental to creating an effective IEP, underscoring the importance of not rushing through discussions to adhere to a predetermined timeline.

For instance, if a parent advocates for specialized tutoring, therapy sessions, or individualized classroom support beyond what the school typically offers, these requests can lead to increased costs. Schools often operate within tight budgets, and they may prioritize compliance with minimum requirements to avoid overextending their resources. 

Moreover, the additional resources needed for customized support can strain school budgets, leading to hesitancy among staff to approve more extensive services. This concern can result in schools offering a "one-size-fits-all" approach, which may not fully address each child’s unique needs.

​Parents should be aware of these dynamics and recognize that advocating for tailored support is essential, even if it may feel like an uphill battle. Under the Individuals with Disabilities Education Act (IDEA), IEPs are mandated to be individualized to meet the unique needs of each child, regardless of cost. Specifically, Section 300.320 of IDEA states that an IEP must be designed to provide a free appropriate public education (FAPE) tailored to the individual student’s strengths, weaknesses, and specific needs. This emphasis on individualization underscores that schools cannot limit services solely based on budgetary constraints; instead, they must ensure that the educational program is aligned with the student's personal goals and requirements.

Schools are required to implement IEPs that truly reflect the unique needs of each student, as highlighted in numerous guidelines and best practices advocated by the U.S. Department of Education​. This means that parents have the right to advocate for the supports and services their child requires, ensuring that financial considerations do not dictate the quality or extent of educational support provided.

If parents disagree with school decisions regarding their child’s education, they have the right to file complaints or request mediation. This process allows for open communication and negotiation between parents and school districts, fostering a collaborative environment aimed at achieving the best outcomes for students​.

By knowing these rights, parents can advocate more confidently and ensure their voices are heard in the decision-making process.  Parents, read this document, and read it well.  Understand and be aware of every written word.  This document will be a great source of confidence in your meetings.

The IEP is Negotiable But Schools Sometimes Respond To Requests With a "No" To Gatekeep.

Parents, so you know, the IEP is negotiable between parents and the school.  You don't have to just sit in the meeting and be told what's "best" for your child.   The IEP meeting is designed to be a collaborative process where both parents and school professionals discuss the student’s unique needs, strengths, and the support that will help them succeed. Under the Individuals with Disabilities Education Act (IDEA), parents are considered equal members of the IEP team, and their input is crucial in determining the goals, accommodations, and services included in the IEP.  However, sometimes parents may not feel this is the case [hint: This is usually because those parent are unprepared for the IEP meeting, and not sure how to proceed when they feel the IEP isn't going well.  No worries, The IEP Advantage course will help you through getting completely prepared.].

Parents have the right to ask questions, request changes, and suggest specific accommodations or modifications. If parents disagree with certain parts of the proposed IEP, they can express their concerns, and the team should work together to find mutually acceptable solutions. This being said, there have been instances where a parent makes a request and is immediately shut down and told no.  Some schools gatekeep this way.  When this happens, the school should provide PWN [prior written notice].  But if it was all verbal, you may not get PWN.    Sometimes, parents walk away, feeling like there was nothing collaborative, equal, or negotiable about that interaction.  There are things parents need to understand about the flow of the IEP meeting, and keeping up on their child's IEP and goals throughout the year, and how to go about making requests with the IEP Team and whom to address.  The IEP Advantage course dives into all of this deeper, but parents, know if this has happened to you... your red flag should go straight up!  If you're not sure what to do at this point, I'll tell you, you NEED The IEP Advantage course ASAP!!!

You can disagree & resolve IEP disputes by going up above the school district.

There is a system of checks and balances within the State Department of Education that oversees your local school district. And the Federal Department of Education that oversees the states. Of course, when you reach out to these agencies, it should be because the school district is not adhering to IDEA regulations or is failing to provide appropriate services for your child. State education departments are responsible for ensuring that local districts comply with federal and state laws regarding special education. They can investigate complaints, provide guidance, and even impose sanctions if necessary.

This oversight is essential for maintaining educational standards and ensuring that children with disabilities receive the services they are entitled to under the law. By documenting issues and escalating concerns through the proper channels, parents can leverage these state resources to advocate for their child's needs effectively. Moreover, understanding this framework can empower parents to engage with the school district confidently, knowing they have a support system in place to help protect their rights and those of their children.

If a parent is experiencing problems with their school district regarding their child's IEP or services, the first step is often to reach out to the school directly to discuss concerns. However, if issues persist or if the school fails to address these concerns satisfactorily, parents can escalate the matter by contacting their State Department of Education. Each state has specific procedures for lodging complaints against school districts, and these agencies are responsible for ensuring compliance with federal and state education laws, including the Individuals with Disabilities Education Act (IDEA).

After contacting the state, mediation may be the next step in the process. Mediation is a voluntary process where a neutral third party helps facilitate discussions between the parents and the school to resolve disputes amicably. This approach allows both sides to negotiate potential solutions and can often lead to a satisfactory resolution without the need for more formal legal actions.

However, if mediation fails or if parents feel their child's rights are still being violated, they have the right to pursue a formal due process hearing. This legal process allows parents to present their case in front of an impartial hearing officer, who will make a binding decision regarding the dispute.

It's crucial for parents to keep detailed records of all communications with the school and any steps taken throughout this process. Documentation can be invaluable in supporting their case during mediation or a due process hearing. By understanding the sequence of actions available—starting from direct communication with the school, progressing to mediation, and potentially culminating in due process—parents can effectively advocate for their child's educational rights.

There is an unspoken "honor code" amongst the school staff and within the school IEP Team. 

Within the school’s IEP team, there can sometimes be an unspoken “honor code” that influences how team members interact and the recommendations they make. Each IEP team is composed of professionals who work closely with each other—often on a daily basis—including teachers, administrators, counselors, and support staff. As a result, there’s a level of interdependence and shared understanding that develops within the team, which can subtly shape the way they approach IEP meetings. Team members know they need to cooperate to keep the school’s systems running smoothly, maintain budget constraints, and balance their workloads, and these dynamics can sometimes create a tendency to uphold the “status quo” in their recommendations and decisions​.

Additionally, team members are often aware that challenging each other’s input or pushing for additional resources could disrupt the working relationship they rely on. For instance, requesting additional accommodations for a student might require extra funding, specialized staff, or extra support hours, which could strain the school’s limited resources. Some members might hesitate to propose these changes for fear of affecting budgets or creating more work for their colleagues. In more challenging cases, staff members may even feel pressured to adhere to the school administration’s preferences to avoid potential conflicts or protect their job security. These unwritten rules can sometimes make it difficult for parents to understand why the team may be reluctant to fully explore more intensive supports or individualized solutions​.

​This “honor code” doesn’t mean that IEP team members are inherently unwilling to support students. Most educators are committed to their students' success and want to meet their needs. However, balancing their responsibilities with school limitations, administrative expectations, and team dynamics can make it challenging to step outside of established norms. For parents, recognizing these dynamics can be eye-opening; it underscores the importance of advocating effectively and asking questions. By being informed and assertive, parents can help encourage team members to look beyond these constraints and fully address their child’s unique needs.

This is why some parents feel it’s them against the entire school team. Let’s be honest—how often do you think a teacher or therapist will go out on a limb, risking conflict with colleagues and the administration, to advocate for exactly what your child needs?
